Terms of Service

1. Acceptance of Terms

By creating an account or using GrowthEngene ("the Service"), you agree to these Terms of Service and our Privacy Policy. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these terms.

2. Description of Service

GrowthEngene provides tools for LinkedIn outreach automation, including profile and job scraping, email discovery and verification, AI email drafting, and multi-step outreach campaign management. The Service requires a valid LinkedIn account and operates within the limits of your plan.

3. Acceptable Use

You agree not to use the Service to:

• Send spam, unsolicited bulk messages, or messages that violate CAN-SPAM, GDPR, or applicable anti-spam laws
• Violate LinkedIn's Terms of Service in ways that could harm other users of the platform
• Scrape or collect data on individuals without a lawful basis under applicable privacy law
• Impersonate any person or organisation
• Harass, threaten, or abuse recipients
• Circumvent rate limits or technical measures in place to protect account safety
• Resell or sublicense access to the Service without written permission

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

4. LinkedIn Automation Risk Acknowledgement

You acknowledge that automating LinkedIn activity carries inherent risk, including the possibility of LinkedIn restricting, suspending, or banning your account. GrowthEngene implements safety measures (rate limiting, proxy affinity, cooldown rules) to reduce this risk, but cannot guarantee that your LinkedIn account will not be affected. You use LinkedIn automation at your own risk.

5. Accounts and Access

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must immediately notify us at rakesh@growthengene.com if you suspect unauthorised access.

6. Plans, Billing, and Cancellation

• Subscriptions are billed monthly or annually in advance.
• All plans include a 14-day free trial with no credit card required.
• You may cancel at any time from your workspace settings. Cancellations take effect at the end of the current billing period.
• We do not offer prorated refunds for mid-cycle cancellations except as required by law or as described in our Refund Policy.
• We reserve the right to change pricing with 30 days' advance notice.

7. Intellectual Property

GrowthEngene and its underlying technology, trademarks, and content are owned by us. Your data — leads, campaigns, emails, and outreach history — remains yours. You grant us a limited licence to process your data solely to provide the Service.

8. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranty of any kind. To the maximum extent permitted by law, GrowthEngene is not liable for indirect, incidental, or consequential damages arising from your use of the Service, including LinkedIn account restrictions, lost business, or data loss.

Our total liability to you for any claim arising under these terms is limited to the amount you paid us in the 3 months preceding the claim.

9. Governing Law

These terms are governed by the laws of the jurisdiction in which GrowthEngene is incorporated. Disputes will be resolved through binding arbitration, except where prohibited by applicable law.

10. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated by email at least 14 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
